These Terms of Use (“Terms”) govern your access to and use of NotyLab websites, applications, downloadable software, tools, documentation, and related services (collectively, “NotyLab”). By creating an account, purchasing a license or subscription, or using NotyLab, you agree to these Terms. If you do not agree, do not use the service.
1. NotyLab
NotyLab provides software and workflows for scientific image analysis, measurement, data analysis, plotting, visualization, and preparation of research outputs. Features may be delivered through web, desktop, or other supported environments and may change over time.
2. Accounts and eligibility
You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and all activity carried out through your account. You must promptly notify us if you believe your account or license has been compromised. You may not sell, transfer, or share access in a way that exceeds the license or plan you obtained.
3. Scientific and professional responsibility
NotyLab is a productivity and analysis tool. You remain responsible for selecting appropriate scientific methods, calibration, acquisition conditions, thresholds, models, assumptions, units, validation procedures, statistical methods, and interpretation of results. You must independently review important results before relying on them in research, publications, quality decisions, regulatory work, clinical work, manufacturing decisions, or other high-impact contexts.
Outputs generated by software can contain errors arising from source data, calibration, algorithm limitations, configuration, user input, or software defects. NotyLab does not replace professional judgment, laboratory standards, validation, peer review, or any certification or regulatory process that applies to your work.
4. Your content and research data
You retain ownership of scientific images, datasets, documents, project information, and other content that you lawfully provide to NotyLab (“User Content”). You grant us only the limited rights necessary to process User Content to provide, secure, troubleshoot, and support the requested service, subject to our Privacy Policy.
You are responsible for ensuring that you have the rights and permissions necessary to upload or process User Content and that doing so does not violate confidentiality duties, intellectual-property rights, privacy rights, export restrictions, research agreements, or applicable law.
Image Authenticity screening processes selected images on your device. Other optional AI assistant features may send text and relevant result details through our AI Gateway to an AI provider. See the Privacy Policy before using online AI features.
5. License and permitted use
Subject to these Terms and the limits of your plan or license, NotyLab grants you a limited, non-exclusive, non-transferable, revocable right to use the service for lawful scientific, educational, research, professional, or internal business purposes. No ownership of NotyLab software, source code, trademarks, designs, documentation, or other intellectual property is transferred to you.
6. Subscriptions, paid plans, and desktop licenses
Some NotyLab functionality may be free and other functionality may require a paid subscription, usage entitlement, desktop license, team plan, or other purchase. Prices, included features, duration, device limits, renewal terms, and applicable taxes are shown at or before purchase. Unless stated otherwise at checkout, access to paid functionality may end or revert to an available free level when the paid entitlement expires.
Payments and refunds are also subject to the information presented at checkout and any mandatory consumer rights that apply in your jurisdiction. Nothing in these Terms excludes rights that cannot lawfully be excluded.
7. Acceptable use
You may not use NotyLab to violate law or third-party rights; gain unauthorized access to systems or accounts; distribute malware; interfere with service operation or security; bypass plan, license, activation, device, or usage restrictions; scrape or overload the service in an abusive manner; misrepresent software-generated results as independently validated where validation is required; or use the service to process content you are not authorized to use.
You may not reverse engineer, decompile, disassemble, or attempt to extract source code except to the limited extent such restriction is prohibited by applicable law or an open-source license expressly permits it.
8. Privacy and analytics
Our handling of personal information is described in the Privacy Policy. NotyLab keeps limited first-party aggregate counters for service measurement and offers separate optional analytics where required consent controls whether Google Analytics and consent-based journey tracking are enabled.
9. Third-party services
NotyLab may interoperate with third-party services, formats, libraries, payment providers, hosting providers, external databases, or links. Third-party services are governed by their own terms and policies. We are not responsible for third-party services that are outside our control.
10. Availability, updates, and changes
We may maintain, update, replace, add, remove, or modify features to improve security, reliability, usability, scientific capability, compatibility, or business operation. We do not guarantee that every feature, integration, file format, operating system, or third-party dependency will remain available indefinitely. We may suspend service when reasonably necessary for maintenance, security, abuse prevention, legal compliance, or circumstances outside our control.
11. Intellectual property and feedback
NotyLab and its associated software, interface, documentation, trademarks, logos, and original content are protected by applicable intellectual-property laws. If you voluntarily send suggestions or feedback, you allow us to use that feedback to improve NotyLab without an obligation to compensate you, while you retain ownership of any underlying User Content included in your message.
12. Disclaimers
To the maximum extent permitted by applicable law, NotyLab is provided on an “as available” and “as is” basis. We do not warrant that the service will be uninterrupted, error-free, suitable for every scientific method, or that every automated or suggested result will be correct. Any warranties that cannot legally be excluded remain unaffected.
13. Limitation of liability
To the maximum extent permitted by applicable law, NotyLab and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, research time, data, or expected results arising from use of or inability to use NotyLab. This limitation does not apply where liability cannot lawfully be limited or excluded.
You are responsible for maintaining appropriate backups of important source data and research outputs and for verifying results before relying on them.
14. Suspension and termination
You may stop using NotyLab at any time. We may restrict, suspend, or terminate access where reasonably necessary because of material breach of these Terms, fraud, abuse, security risk, non-payment, legal requirements, or conduct that threatens NotyLab or other users. Where appropriate and practicable, we may provide notice or an opportunity to remedy the issue.
15. Changes to these Terms
We may update these Terms as NotyLab evolves. The “Last updated” date above identifies the current generated version. If a change materially affects existing users, we may provide additional notice where appropriate. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by applicable law.
16. Applicable law and mandatory rights
These Terms are interpreted subject to applicable law. Mandatory consumer, data-protection, employment, research, or other statutory rights that cannot be waived remain in force. Nothing in these Terms is intended to deprive you of protections that applicable law requires.
